Has anyone taken DirecTV to Small Claims Court?

The idiots installed my son's dish at college in the winter when no leaves were on the trees. Naturally in the spring he couldn't get reception. There was no other location for the dish per the condo rules so we had to cancel. Then they took $260 out of our checking thru our debit card without our consent as an early cancellation fee. How can they do all this and get away with it?

Has anyone taken DirecTV to Small Claims Court over these types of stupid things? Are they allowed to do anything they want and get away with it? Please post your results if you've ever taken them to court. It would be appreciated by all of us posting.

you are not even going to win that one first of all your son or someone who he designated was there for the install and signed for it and the agreement. He (or you depending on where the bill was being sent) got a copy of the agreement in the mail, and here it is word for word from section 5 cancellation row e 

(e) Payment Upon Cancellation. You acknowledge that you have provided your credit or debit card account information to us. You understand that you will incur fees and charges as a result of your receipt and use of Service and/or Receiving Equipment, and may incur early cancellation fees and/or equipment non-return fees (as specified in any lease, programming or other service commitment agreement you entered into in connection with obtaining Receiving Equipment). By giving us your credit or debit card account information, you authorize us to apply this method of payment, in accordance with applicable law, to satisfy any and all amounts due upon cancellation. You further acknowledge that you are required to maintain current credit or debit card information with us and agree to notify us whenever there is a change in such information, such as a change in the card number or the expiration date. 

they are covered by the customer agreement on every level and with some really good lawyers you will just be wasting your money, and if you try, you alone will not have a chance of winning, but I am not saying you will have a chance with a lawyer either.

Direct TV ***, they charged me $200 in upgrade fees because they took the order down wrong. I cancelled my credit card and repoted them for credit card fraud. That's what it really boiled down to anyway.

I have had Direct TV for over 10 years and they have always been easy to deal with when I had a problem. Maybe it's not their attitude that is causing the problem but the attitude of some of the complainers.

I am a landlord. Had tenants evicted only to discover that they had direct tv satellite installed? called them to remove dish, they said it would cost more to send their tech out than the dish is worth and that my beef was with the tenants, not them. BALONEY!!

This is directed at Scott West. Get a new job. Direct TV colllection agency ***. I have been a loyal customer of Direct TV for over 6 years now. I was going tocancel service two months ago until I found out that a 380.00 earlt termination fee a[[lied. And yes you sined a legally binding contract which will only be nullified if they do not provide the service they are agreeing to provide. After being informed of the fees I asked to speak to a manager and after speaking with the manager I received a $100.00 credit immediately plus a $10.00 monthly credit and free showtime for 6moths which I was paying $12.00 per month for and the Starz package free for 6 months. Needless to say I was happy with the solution provided. The secret to getting what you want out of the deal is to be nice. You need to understand that they have hundreds of people that they deal with on a daily basis and they have a job to do. If you call cussing and screaming and threatening they will immediately get defensive. It's human nature. If you kill them with kindness you will in most instances get what you want as long as it is a reasonable request. The best thing to do is to state your issue and then ask them what they can do for you.

:eek I was a customer of Directv for well over 4 yrs. In January 2008, we purchased a house in another state. I called directv to set up services at our new home. They never came, so i called back and was told it was not entered into their system, so they set up another date, I waited 3 weeks past the install date and called them back and told them never mind, i already had cable scheduled to be installed. They sent a box by FedEx for me to send my reciever back, which i did. About 2 weeks later i recieved a bill for 338.00, my cureent charges plus they were charging me for the reciever i already sent back to them. I contacted Directv and they said they never recieved the reciever. So i then contacted the BBB out of California and the FTC and after they were contacted by the BBB, they dropped the reciever fee. I will never do business with them ever again. I think after being a loyal customer for over 4 yrs, they should not have treated us this way.

In a Nut shell It happen to me to. Customer of 4 years had a broken receiver was issued a new receiver all I had to pay for was shipping and handling, I was told. Sent me out another broken receiver. 4 days into this and I had it. I canceled my services, took a look at my account and they took $338.32 out. Oh My GOD.. I called them spoke to three different people. Nothing... Any Lawyers out there who want to take this on please help us. I have contacted 5 on your side in my town, BBB, And THE FTC. Get this the woman at the FTC( Federal Trade Commission)say she has been hearing this alot about direct tv. very important that you file a claim with them. phone number is 877-382-4357. Also your local BBB. also Consumer Protection, in your area, the FTC can give you the number. Direct TV will be giving me my money back, how about you. Call your Attorney General. If you are interested contact me remember there is strength in numbers.

Panhead - there is a suspend option for services, we use it for our lake house each year because of the leaves in summer.You could have used suspend to avoid canceling. Also, if you have a credit card on file with any company these days it can be legally charged for early cancelation fees, look at your customer agreement, my cell phone does the same thing. Nothing illegal is being done here, it's just in the fine print everyone ignores.

I have a small claims court date in August against DirecTV. I'll let you know how it goes.
